Terms & Conditions

For venue Hire including art studios and co-working spaces

 

1. Facilities:

Full venue hire: includes access to the following parts of the venue: bar area, lounge area, two bathrooms and all clear spaces. The venue hire includes general utilities (water, power, internet), set up items (couches, plants, fridge, cooking equipment) and venue consumables (toilet paper, soap, etc.). If a large amount of waste is expected to be produced at the event, the client will need to take away all waste, or extra bins can be hired for an additional cost. Usage of the downstairs outdoor area can be discussed individually, depending on the date and time of the event and intention of use. No access to co-working and art studio space.

Partial venue hire, Art Studios and Co-working space: sole or shared access to the venue areas and items used will be discussed individually.

2. Access:

The venue is hired out on an hourly basis and gives the client access to the venue for the amount of hours stated in the invoice. This includes all set up and pack down time as well as the event. The minimum hire time for weekdays is 2.5 hours, on weekend nights 6 hours.

Art Studios and Co-working space: dates and times of access will be discussed individually.

3. Storage:

Storage is limited, and amount of storage space will be subject to availability. All merchandise and equipment brought into the premises must be taken at the end of the hire period. 

The venue will take all necessary care of the client’s property but will take no responsibility for loss or damage to this property. It is suggested that the client arrange for insurance and/or security of equipment should they deem it necessary.

4. Care of premises

Set up items can be moved within the space with the consent of the venue manager. This needs to be done with the utmost care to avoid damage to the items or floor. All items need to be moved back to their original position within the time frame of hire. If items are not being moved back, an additional re-set fee might be charged.

Nothing may be nailed, screwed, stapled or adhered to any wall, fixture or building without the consent of the venue manager. Damage to linen, upholstery and furnishings should be avoided by covering the couches with fabrics when in use for large events.

Damage: Any damage will be charged at the replacement or professional repair cost and will be invoiced directly to the client with payment due within seven days. Furthermore the client is responsible for any damage, pilfering, breakage sustained on or to the premises or to equipment used, hired or owned, caused by the client, client’s guests, outside contractors or any other persons attending or visiting the event.

Cleaning: A cleaning fee may be charged, in case the venue is left in an unacceptable condition. No additional cleaning fee is charged for hiring art studios and co-working spaces.

5. Other conditions of use

Licencing: The Button Factory is not an alcohol licensed venue. The sale or supply of alcohol may be arranged by the Button Factory team through a special licence application and will be discussed individually.

The venue is not licensed for food preparation. All catering intended to be sold at the venue (except for ready-to-eat meals and snacks) must be prepared externally.

Prohibited and restricted activities: No naked flames (including candles), pyrotechnics or fireworks of any kind are permitted in the venue. If any activity taking place at the venue is classed as dangerous activity, the client will need to provide evidence of a Public Liability insurance before gaining access to the premises.

Noise & Sound Levels: Whilst our venue is located in a city centre zone, noise levels can be considered high, especially when doors and windows are left open. Please follow the instructions of the venue manager at all times. 

If the Police or Noise Control arrives at the venue due to a complaint, the client is to comply with all reasonable and legal requests. If equipment of the Button Factory is impounded, the client must retrieve or replace it immediately and pay all associated costs and fines.

6. Emergency Procedures

In an event of emergency, please follow the instructions of the venue manager. If the fire alarm sounds, please leave the building immediately by the nearest safety exit and follow the venue manager to the assembly point. Leave your personal belongings behind.

7. Payment Terms

Venue Hire up to a total of $230: 100% of the gross venue hire fee (this includes charges for add-ons like sound system, additional infrastructure, cleaning fee etc.) will be charged at the time of booking and acts as booking confirmation. The invoice will need to be paid within 48 hours of receiving to confirm the booking.

Venue Hire above a total of $230: A deposit of 50% of the gross venue hire fee (this includes charges for add-ons like sound system, additional infrastructure, cleaning fee etc.) will be charged at the time of booking and acts as booking confirmation. The invoice will need to be paid within 48 hours of receiving to confirm the booking. The remaining 50% of the gross venue hire is to be paid 7 days prior to accessing the venue.

Art Studio and Co-Working space: Fees will be charged regularly for 4 weeks in advance.

8. Cancellations & Refunds

Venue Hire: The deposit is non-transferable and non-refundable.
If the booking is cancelled by the client up to 7 days before the hire date, 50% of the full venue hire fee will be charged.
If the booking is cancelled by the client 7 days or less before commencement of booking, the hirer is liable for paying 100% of the full venue hire fee.

The Button Factory has the right to terminate the hire contract, if any terms set in the contract or T&Cs are not adhered to by the client. The same refund conditions apply as when cancelled by the client.

Art Studio and Co-working spaces: Short term hire agreements can be cancelled with two weeks notice. Long term agreements can be cancelled with six weeks notice.

10. Force Majeure

Neither party may be held responsible for any act, omission or circumstance due to an event beyond their control which what party could not have avoided with a reasonable effort, providing it advises the other party in detail and in writing as soon as possible after the occurrence of the said event, and that it takes reasonable steps to remedy the situation quickly and remove the cause of those acts, omissions or circumstances. The Button Factory cannot be held liable if it is prevented from fulfilling the set terms of the contract due to circumstances beyond its control, such as Acts of God, earthquake, riot, flood, terrorism, explosion, law or Terms and conditions apply. 

11. Insurance

The Button Factory strongly advises all Clients to have public liability and other necessary insurance legally required or recommended for the particular type of event taking place at the venue. The public liability of the Button Factory does not cover public events organised by external promoters.

12. Indemnity

The Client shall indemnify and keep indemnified The Button Factory from and against all loss, damage or liability, whether criminal or civil, suffered by The Button Factory, which may be incurred by, done by or happen to the Client or the Client’s employees or agents by or to any other person resorting to The Button Factory by reason of the use of the venue by the client. The Button Factory will not indemnify clients for any loss, damage or liability, whether criminal or civil, suffered by the hirer. The Button Factory is not responsible for any property left behind. Notwithstanding the above the provisions of the Health and Safety in Employment Act 2002 at all times take precedence.

13. Amendments

The Button Factory reserves the right to add to or amend these Terms from time to time as required. Amendments will take effect when published on the website. Additionally, these terms are subject to change at any time due to government restraint, strikes or any other causes not reasonably within the control of the venue. 

By paying your deposit or weekly hire fee you have acknowledged and are in agreement with all the terms and conditions stated on this page.
